A man who allegedly cheated on his wife demands R15 000 as spousal support from the court.
As reported by news publication, IOL, the woman filed for divorce from her husband of 25 years, on allegations of cheating and abuse.
During the court hearing, she alleged that her ex-husband wanted access to her pension fund, as well as the joint estate’s homes and cars and that he had physically, verbally, and financially abused her. According to the above-mentioned source, the woman stated in court that the abuse began in 2006, when her husband beat her, causing major injuries to her right hand.
Here’s a few things she mentioned in court:
- After her ex-husband resigned from his job he didn’t share his pension fund with her.
- He had been cheating on her throughout the marriage.
- She says that he is capable of taking care of himself and is not entitled to any money from her.
- Lastly, she denies the allegations of assault against her husband.
The former couple have a property in Savannah, where she received R430,000 and used it to pay household debts and also settled the children’s school fees which were in arrears.
Judge Elizabeth Kubushi said, “The allegations of the extramarital relationship by the defendant alleged in the particulars of claim are not proven and she was unable to show the allegations of assault and abuse that was proven, amounts to substantial misconduct, adding, “The defendant (husband) seeks to maintain the lifestyle enjoyed by both parties during the marriage, yet, he proffered no evidence to proof the type of lifestyle they enjoyed during their marriage. Nor did the defendant tender evidence to prove his financial needs and obligations monthly to justify his claim for R15,000.”
According to the judge, the couple was married in a community of property, meaning that the communal estate would be divided equally between them.
