TV presenter and musician, Khaya Mthethwa finally emerged victorious in a decade-long court battle against a reputable insurer, MiWay.
The legal dispute that ended up before the magistrate comes after MiWay refused to settle his claim following his car accident on the 26th of December in 2016.
Recently, the Luvela Kuwe singer took to his Instagram page to share his outburst about MiWay not responding to his emails and letting him know when his claim will be settled after he won the case.
In his post, he shared supporting documents to prove that the Gauteng High Court ruled in his favour. In his caption, he wrote: “MiWay insurance, I’d like to know why our emails since November 2024 have been ignored by your legal department? My claim was declined in 2016 and I finally got my day in court with you guys last year in February and we won the case!! Now it’s a mission to get you guys to settle this claim and I’m sick and tired of chasing. I really hope I’m the only person getting this kind of treatment.”
A part of the documents shared read: “The plaintiff instituted an action against MiWay Insurance Limited after the insurer repudiated his claim for indemnification under the policy insurance pursuant to a motor vehicle accident that occurred at around 05h30 on the morning of 26 December 2016, wherein the insured vehicle was damaged.
“From proven facts and the evidence before me, there is no evidence that suggests that Mthethwa supplied the insurer with dishonest information relating to the speed he was driving, and how the accident occurred.
“The insurer cannot succeed with its grounds for repudiation as pleaded. Consequently, the plaintiff is entitled to judgment in his favour.”

Under the post, Instagram users took turns to share similar frustrations about MiWay insurance.
In the latest post, Khaya shared a video on his Instagram page confirming that the insurance settled the claim. However, it may reflect on his account during the week.
He expressed his gratitude to those who supported him during this dispute and to those who shared their stories about the insurance company.
